Problem questions

Many students ask themselves how to answer law problem questions:
Just follow the Issue, Relevant law, Application to facts, and Conclusion (IRAC) system:

• Identify who the parties are and what the legal issues are, which have to be discussed.
• Then state the applicable law, for example cite relevant cases and/or statutes.
• Subsequently, apply the law to the facts of the problem question. Do not simply restate the law, but make sure that you apply the law properly in this part, as this really shows that you have understood the law in a practical sense.
• Conclude your answer by giving solutions and evaluate and analyse the law and if there are insufficient facts, also make this clear. Sometimes, you can also advise the parties of the likely success.
